Affiliate Terms of Use Policy

These Affiliate Terms of Use (the “Agreement”) govern your participation in the Brandaid Marketing Affiliate Program (the “Program”). By applying to become an affiliate, accessing your affiliate dashboard, or promoting Brandaid Marketing in any way through the Program, you agree to be bound by this Agreement.

This Agreement is a legal contract between you (“Affiliate,” “you,” “your”) and Brandaid Marketing (“Brandaid Marketing,” “we,” “us,” or “our”).

If you do not agree to these terms, you may not participate in the Program.

1. Enrollment in the Affiliate Program

1To enroll in the Program, you must complete the affiliate application process and provide accurate and complete information.

We reserve the right to accept or reject any application in our sole discretion, for any reason, and at any time.

You agree that we may contact you regarding your application and participation in the Program via email and other reasonable communication methods.

2. Affiliate Relationship

You acknowledge and agree that you are acting as an independent contractor. Nothing in this Agreement creates a partnership, joint venture, employment relationship, or agency relationship between you and Brandaid Marketing.

You do not have authority to bind Brandaid Marketing to any contract or obligation.

3. Affiliate Links and Tracking

Upon acceptance into the Program, you will be provided with a unique tracking link (an “Affiliate Link”).

Affiliate commissions are tracked through cookies and the affiliate tracking system we use.

Cookie Duration

The Program uses a 90 day cookie. This means:

- If a user clicks your Affiliate Link and purchases within 90 days, you will be credited for the referral, provided the purchase is properly tracked.

- If the customer clears cookies, uses a different device, blocks tracking, or otherwise prevents tracking, the referral may not be credited.

Brandaid Marketing is not responsible for tracking issues caused by browser settings, ad blockers, device changes, or technical issues outside of our control.

4. Commission Structure

Commission Rate

Affiliates earn a 20% commission on qualifying purchases made through properly tracked Affiliate Links. Any purchase made by a referral that did not use an affiliate link will not be credit towards an affiliate, even if it is determined later that they referral was actually referred by the affiliate. Affiliate links are the only way we can accurately track referrals.

Qualifying Purchases

Commissions are only earned when:

- the purchase is made through a properly tracked Affiliate Link

- the customer completes payment successfully

- the transaction is not refunded, disputed, charged back, or reversed

- the purchase is not determined to be fraudulent or abusive

No Self Referrals

You may not use your own Affiliate Link to purchase Brandaid Marketing products or services for yourself.

Any self referral purchases may result in:

- forfeiture of commissions

- removal from the Program

- termination of your affiliate account

5. Payouts

Payout Method

All affiliate payouts are made via PayPal only.

You are responsible for ensuring your PayPal email and payout information are accurate and up to date.

Payout Schedule

Affiliate commissions are paid on a monthly basis, typically within 15 business days after the end of the month.

Minimum Payout Threshold

Brandaid Marketing may enforce a minimum payout threshold. If a minimum threshold applies, it will be communicated in the affiliate dashboard or affiliate documentation.

Refunds, Chargebacks, and Disputes

If a customer refund, chargeback, dispute, or cancellation occurs, the related commission will be:

- removed from your account

- deducted from future payouts, if already paid out

6. Affiliate Responsibilities and Conduct

You agree to promote Brandaid Marketing ethically, honestly, and in compliance with all applicable laws and regulations.

You may not:

- make misleading, deceptive, or false claims about Brandaid Marketing

- imply guaranteed income, guaranteed results, or unrealistic outcomes

- use spam, unsolicited messaging, or unethical advertising methods

- publish content that is defamatory, hateful, abusive, or illegal

7. FTC Disclosure Requirements

You must comply with all FTC endorsement and disclosure requirements.

Whenever you promote Brandaid Marketing, you must clearly disclose your affiliate relationship.

A compliant disclosure example:

“This post contains affiliate links. If you purchase through my link, I may earn a commission.”

Disclosures must be:

- clear

- easy to notice

- placed near the affiliate link or endorsement

8. Restricted Advertising and Prohibited Marketing Methods

You may not:

- run paid ads that impersonate Brandaid Marketing

- create websites or landing pages that appear to be Brandaid Marketing owned

- register domains or social accounts that include our business name or confusingly similar variations

- bid on Brandaid Marketing branded keywords in pay per click advertising, unless explicitly approved in writing

Brandaid Marketing reserves the right to determine what constitutes prohibited advertising in our sole discretion.

9. Intellectual Property and Brand Use

Brandaid Marketing owns all rights to its trademarks, branding, content, and marketing materials.

You are granted a limited, revocable, non exclusive license to use approved Brandaid Marketing brand assets solely for participation in the Program.

You may not:

- alter logos or brand assets without permission

- claim ownership of Brandaid Marketing intellectual property

- create derivative works of our content without written approval

10. Term and Termination

1This Agreement begins when you are accepted into the Program and continues until terminated.

Termination by Either Party

Either you or Brandaid Marketing may terminate this Agreement at any time, with or without cause.

Termination for Cause

We may terminate your participation immediately if you:

- violate this Agreement

- engage in deceptive or unethical marketing

- attempt to manipulate tracking or commissions

- damage or threaten the reputation of Brandaid Marketing

Effect of Termination

Upon termination:

- you must stop using Affiliate Links and Brandaid Marketing branding immediately

- any unpaid commissions may be forfeited if earned through prohibited conduct, fraud, or violations of this Agreement

11. Confidentiality

You agree to keep confidential any non public information shared with you through the Program, including but not limited to:

- commission structures not publicly listed

- internal communications

- customer or order data

- affiliate dashboard data

12. Disclaimer of Warranties

The Program is provided “as is” and “as available.”

We make no guarantees regarding:

- commission amounts

- conversion rates

- earnings

- tracking reliability

- business success

You acknowledge that results vary and depend on many factors outside of our control.

13. Limitation of Liability

To the maximum extent permitted by law, Brandaid Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, or business interruption.

Brandaid Marketing’s total liability under this Agreement will not exceed the total commissions paid to you during the three month period immediately prior to the event giving rise to the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Brandaid Marketing, including its owners, employees, contractors, partners, and affiliates, from any claims, liabilities, damages, losses, costs, and expenses (including attorney fees) arising from:

- your marketing content or promotional activities

- your violation of this Agreement

- your violation of any law or regulation

- your misrepresentations or deceptive claims

15. Modifications to This Agreement

We may update or modify this Agreement at any time.

If changes are made, the updated Agreement will be posted on this page with a revised Effective Date.

Your continued participation in the Program after changes are posted constitutes your acceptance of the updated Agreement.

16. Governing Law

This Agreement will be governed by and interpreted in accordance with the laws of the State of Nevada, without regard to conflict of law principles.
